Listmates, I am in need of some advice regarding prosecution of unpermitted flood plain alteration.
Last month, I began representing a small village as their attorney and prosecutor. Sometime within the past few years, the village board became aware of a resident who was altering a floodplain within village limits without a permit. The individual was asked to apply for a floodplain permit but did not do so. Several letters notifying the individual of the violation were then sent and received, but the individual did not comply and continued on. The village also did not take any legal action during this time, for reasons unknown to me. Now, the State has demanded the village bring the property into compliance with State floodplain development code.
Does anyone here have any experience with a similar situation, either inside or outside of the courtroom? If so, I would appreciate any advice on remedying the situation.
