Greetings Listmates,
I represent a municipality that owns a fairly large parcel of ground on the outskirts of the city limits. There is a massive amount of activity occurring on the parcel year-round by a number of different entities and groups. Many of the leases the city has previously granted for the property are decades old or have been either misplaced or were oral handshake agreements. The city's insurance provider has asked city administration to update all relevant leases to shore up the potential liability exposure and account for the modern legal environment.
Located on this parcel are the following:
- the municipal airport;
- ~40 acres of farm ground surrounding the municipal airport, which has historically been subleased to a local farmer directly at the airport authority's discretion;
- the city gun club;
- the local fairgrounds, which includes an event center which can be rented by the public, plus livestock arenas and several smaller outbuildings which host the county fair and various events of all kinds, from airplane shows to craft fairs;
- the Legion baseball field;
- the local semi-private country club golf course; and
- the city's wastewater treatment plant and city water control facilities.
There are clearly quite a few activities conducted across this parcel by at least the six semi-permanent lessees-the municipal airport authority, the gun club, the county fair association, the Legion and youth baseball programs, the country club, and the City-and other occasional users of the various venues.
My questions are: (1)- would any members be willing to share relevant leases which they have either prepared or reviewed between a municipality and any local equivalents of the above-mentioned entities; and (2)-given that there is an airport on the property, I assume there are Federal Aviation Administration (and perhaps state statutory) implications and certain prohibited activities; do any members have any advice or insight on how to ensure the City and all of its leases and lessee activities are in compliance with FAA regulations?
